Whitehorse Rapids Generating Station Compensation Claims

Yukon Energy’s existing Water Use Licence (Licence HY99-010) for the Whitehorse Rapids Generating Station (WRGS) authorizes Yukon Energy to use water in the Yukon River, which comes from Marsh, Tagish and Bennett lakes, as well as from Atlin and other parts of the Southern Lakes area, to generate renewable electricity at the WRGS. Our existing licence expires on May 31, 2025. We are seeking to renew our existing licence for a term of twenty years. We wish to identify individuals who believe that they will be adversely affected by the ongoing operation of the WRGS over the 20-year renewal period (2025-2045) and who may have a potential compensation claim under the Yukon Waters Act. The following factors are relevant to determining compensation claims for the renewed licence period:

• provable and/or potential loss or damage;
• the extent and duration of the adverse effect, including the incremental adverse effect;
• the extent of use of water by persons who would be adversely affected; and/or
• nuisance, inconvenience and noise.

We are asking that anyone claiming potential damages related to the operation of the WRGS during the renewal term, whether to property or from other causes, submit the form below to us via email or mail by January 15, 2025.

When we receive your form, a representative from Yukon Energy will follow up by phone, email or in writing to clarify submitted information and to discuss potential compensation. People that do not wish to address potential claims related to the renewed licence with Yukon Energy, or who are not able to agree with Yukon Energy regarding potential compensation, may provide notice to the Yukon Water Board as part of the future Yukon Water Board hearing process for the 20-year licence renewal. This hearing process is anticipated to occur in the spring of 2025.
